I reserve all rights to my artwork.

I reserve the ability to post commissioned artwork and designs to my socials to promote and use as examples of my work.

I reserve the right to refuse to sell, trade, or gift a design to anyone for any reason. I also reserve the right to refuse commissions to anyone for any reason.

> > > This includes people who are scammers, rude, engage or support NFTs / Generative AI, who make me uncomfortable, who I fall under the DNI of, or people who are blocked / privately blacklisted.

Any art, designs, and customs I create, commissioned or otherwise, is not allowed to be used for NFTs or generative AI. If someone is caught doing this they will be blacklisted from further interactions and services from me.

I do not do payment plans at this time.

Payment will be made in USD only.

False bids placed on an auction will result in a month blacklist. Repeated offenders will be permanently blacklisted.

I reserve the right to decline a commissioned artwork or custom design if I feel I cannot complete it. The decision for this refund will be made at my own discrecion.

Any edits or drawing over my artwork is not allowed. Please contact me if you would like any changes made to a premade design, custom design, or commission.

Commissioned artwork, premade designs, and custom designs are for personal use only.

I do not offer commercial rights at this time.

I reserve the right to revoke a design for the following reasons:

> > > If the design’s Toyhouse profile is deleted or fully inaccessible in a closed account

> > > Unless it is communicated beforehand you are moving off-platform with said design.

> > > If payment is not received.

> > > If a chargeback is issued through Paypal.

> > > Designs will NOT be revoked for breaking Terms of Service. However, you will be blacklisted from owning any future designs of mine.

You are free to make changes to a design, such as: species, color pallet, markings, body type, gender, anatomy, the way that hair or fur tuft is specifically shaped, etc).

> > > This includes modifying the design however need be to accommodate for your art style.

> > > The design however must still resemble the original design in some way (ex: don't change a cottagecore mushroom cat into a cyberpunk dog).

> > > Do not draw over my artwork of the original design to make these changes.

> > > I am open to making slight alterations to a premade design before purchase (such as some color alterations, species changes, small anatomy changes).

You may sell, trade, and gift a design if you traded for or purchased it.

If you obtained a design for free (such as through a raffle, FCFS, or other free methods), they must have some added art before being traded or sold.

> > > Freebies can be regifted freely without restriction.

Do not resell designs for more than its value unless there has been added artwork.

> > > Art that adds value includes commissioned and personal* art. Gift art and art from art trades DO NOT count.

> > > *Personal art on freebie designs must show some amount of effort in the drawing. Aka don’t make a bunch of black and white sketches just to raise the value of a design rapidly.

You cannot claim the original design as your own work or art.

Do not remove my credits from the design or creator credits on the design’s Toyhouse profile.

Do not add yourself as a designer to the design’s Toyhouse profile.

> > > If you make a significant enough redesign to the design you feel this is warranted please ask me first.

If you own a design I have made, whether via custom or premade design and become blacklisted, you are allowed to keep those designs. However, upon becoming blacklisted you are not allowed to own any future designs made by me.

I take custom payment upfront

A full refund is available until the sketch of the custom is finalized. Once the sketch has been confirmed for further work by the purchaser, a refund is no longer available.

I reserve the right to decline or stop work on a custom design if I feel I cannot complete it.

> > > This includes being uncomfortable with the subject matter or drawing things I feel are way beyond my skillset as to hinder my ability to deliver a satisfactory result for both parties.

> > > If an alternative solution to the problem work cannot be agreed upon, I will issue a complete refund. The decision for this refund will be made at my own discretion.

I take commission payment upfront

A full refund is available until the sketch (or lineart for specific types of commissions) has been finalized. After the sketch (or lineart) has been confirmed for further work by the purchaser, a refund is no longer available.

I reserve the right to decline or stop work on a commissioned artwork if I feel I cannot complete it.

Do not remove my credits from a design’s Toyhouse profile on either the creator or designer sections.

Do not add yourself as a designer to the design’s Toyhouse profile.

Please do not donate my designs to Freebie / Trade shelters on Toyhouse forums. This includes shelters where designs are received and either given to other users for free (nothing in exchange), shelter currency (obtained from donating art/characters to the shelter), or other characters/art directly. Oftentimes designs end up not finding new homes when put into shelters and instead remain inactive for months to years at a time.

> > > If at any point you are unable to rehome a design I will accept the design ownership and profile being transferred back to me. If you give back a design this way I am free to keep for myself, resell, trade, or give away the design for free to a new owner.

> > > I cannot stop you from donating designs to these shelters but please consider alternatives if possible!

Do not delete a design's Toyhouse profile or original image. This includes closing your account with the design's profile still on it (as this makes it inaccessible to anyone).

> > > If at any point the current owner of the design does not want the design and are unable to resell, trade, or gift them away, I will accept the design's ownership and profile to be transferred back to me for recordkeeping purposes.

If a design is sold to a person who does not have a Toyhouse account, I would prefer that they either create a Toyhouse profile to store the design's profile or that the design profile be sent to me for recordkeeping purposes. This is however just a preference and I cannot necessarily enforce this, but please do consider it for both clarity and recordkeeping purposes, thank you!
